LAND DIVISION AND AMALGAMATION
Our team can guide you through land division and/or amalgamation processes using clear and easy to understand communication methods. We understand that the process can be daunting and confusing for our clients and our clear approach, genuine interest and passion we pour into each transaction ensures your interests are well looked after.
Land division includes:
• The alteration of the boundaries of land
• The division of land into at least two or more allotments
• Large scale developments containing numerous allotments by Torrens Title, Community Title or Community Strata Title (or for an existing strata scheme – Strata Title).
Division of land requires the approval of the local council, statutory authorities and the State Commission Assessment Panel. To finalise the process, documentation and the Plan of Division (D) must be lodged at the Lands Titles Office (LTO). Dividing land is a costly and timely process. It is recommended that thorough research and proper preparation is made before beginning the division.
Amalgamation is the combining of one or more allotments to create one single parcel of land.
A plan for an amalgamation of land must be lodged with Land Services SA and will only be considered if:
• The allotments are next to each other and are not physically separated e.g. adjoining land
• Land ownership and any registered estates or interests is the same for all allotments
• The result is one allotment
You should seek professional assistance from a survey or drafting services firm. It is important to note that once amalgamation is pursued if you wish to divide the land in the future, you will be required to carry out the land division process.
